Intelectual Property Rights
Upon full payment, Buyers receive all intellectual property rights, including copyrights, for the delivered work unless their chosen Service Package specifies otherwise. For clarification, Service Provider agrees to assign all rights, title, and interest in the delivered work to the Buyer according to these Terms.
Certain service offerings, including custom-created work, may require additional payments (via Add-ons) for a Commercial Use License. If you purchase the Service Package for personal use, you will own all the necessary rights for that use without needing a Commercial Use License. However, if you plan to use the work for any commercial purpose, you will need to purchase the Commercial Use License through a Package Add-On to obtain broader rights for business use.
Additionally, unless explicitly indicated otherwise by Buyers, any content voluntarily sent to BeautyRetouching.net, including texts, photos, videos, usernames, user photos, user videos, and any other information, may be used by BeautyRetouching.net without compensation for marketing or other operational purposes relevant to the Site.
When you purchase a "Commercial Use License" with your Package or Add-on, the Service Provider grants you broad rights to use the delivered work, except for the rights to resell the work. To clarify, the Service Provider retains all ownership rights. "Permitted Commercial Purposes" include any business-related use such as advertising, promotion, creating web pages, integrating into products, software, or other business-related tools, and excludes any illegal, immoral, or defamatory use. There is no warranty, expressed or implied, with the purchase of this delivery, including any warranties of fitness for a particular purpose. BeautyRetouching, or the direct Service Provider, will not be liable for any claims or incidental, consequential, or other damages arising from this license, the delivery, or your use of the delivery.
Your utilization of the site, its content, and any services or items acquired through the site is undertaken at your own risk. The site, its content, and any services or items procured through the site are provided on an "as is" and "as available" basis, devoid of any warranties of any nature, whether express or implied, contingent upon our adherence to reasonable professional diligence. Neither BeautyRetouching nor any individual affiliated with BeautyRetouching offers any warranty or representation regarding the comprehensiveness, security, reliability, quality, accuracy, or availability of the site.
The foregoing does not affect any warranties which cannot be excluded or limited under applicable law.
Provided that we have adhered to reasonable professional diligence, under no circumstances will BeautyRetouching, its affiliates, or their licensors, service providers, employees, agents, officers, or directors be liable for any damages, regardless of the legal theory, arising from or related to your use or inability to use the site, any websites linked to it, any content on the site or such other websites, or any services or items obtained through the site or such other websites. This includes, but is not limited to, direct, indirect, special, incidental, consequential, or punitive damages, including personal injury, pain and suffering, emotional distress, loss of revenue, loss of profits, loss of business or anticipated savings, loss of use, loss of goodwill, loss of data, and whether caused by tort (including negligence), breach of contract, or otherwise, even if foreseeable. The foregoing does not affect any liability that cannot be excluded or limited under applicable law.
